Tenants Deposits

The Tenancy Deposit Scheme (TDS) is a government approved tenancy deposit protection scheme in England and Wales operated by The Dispute Service Ltd. The Housing Act 2004 requires landlords and letting agents to protect deposits on assured shorthold tenancies in a scheme such as the TDS or similar. They provide insurance backed tenancy deposit protection with free, impartial dispute resolution for when disagreements arise over how the money should be divided at the end of a tenancy.

From the 1st June 2019 the security deposit (covering damage or defaults on the part of the tenant during the tenancy) will reduce from six weeks rent to five weeks rent. However where the rent exceeds £50,000 per annum the security deposit will remain as six weeks rent.

From 1st June 2019 the Tenant Fee Ban comes into force in the UK. Whilst some charges are due to be abolished and/or amended under the Bill, as well as paying the rent tenants will also be required to make permitted payments.
Permitted payments are
Before the tenancy starts (payable to the Agent)
Holding Deposit: 1 week’s rent
Deposit: 5 weeks’ rent
During the tenancy (payable to the Agent)
Payment if you want to change the tenancy agreement
Payment of interest for the late payment of rent
Payment for the reasonably incurred costs for the loss of keys/security devices
Payment of any unpaid rent or other reasonable costs associated with your early termination of the tenancy
During the tenancy (payable to the provider) if permitted and applicable
Utilities – gas, electricity, water
Communications – telephone and broadband
Installation of cable/satellite
Subscription to cable/satellite supplier
Television licence
Council Tax
Other permitted payments
Any other permitted payments, not included above, under the relevant legislation including contractual damages.
